# Terms of Service

## 1. Acceptance

By accessing or using Encypher's platform, APIs, plugins, extensions, command-line tools, or websites (the "Service"), you agree to these Terms. If you accept for an organization, you represent that you have authority to bind it. If you do not agree, do not use the Service.

## 2. Service

Encypher provides content provenance signing, verification, rights-expression, and related operational tools. A cryptographic signature records integrity and signer information. It does not prove that content is true, lawful, or admissible in a particular proceeding.

## 3. Accounts and credentials

You must provide accurate account information, protect credentials and API keys, and report suspected compromise. You are responsible for activity performed with credentials issued to your organization.

## 4. Authorized use

You may use the Service only for content and systems you own or are authorized to operate. You must not use the Service to impersonate others, sign unlawful or deceptive content, evade limits, extract keys, disrupt the Service, or violate third-party rights.

## 5. Customer content and data

You retain rights in your content. You grant Encypher the limited rights needed to provide and secure the Service. Processing and retention follow the Privacy Policy and any approved written agreement that applies to your organization.

## 6. Fees and service terms

Published plan terms apply unless an approved written order or agreement states otherwise. Support channels and any response, resolution, availability, or service-credit commitment apply only when shown in current contracting evidence for your organization. The public status page is a live operational snapshot, not proof of service-level attainment.

## 7. Intellectual property

Encypher retains its rights in the Service, software, marks, and documentation. These Terms do not transfer those rights. Feedback may be used without restriction unless a written agreement states otherwise.

## 8. Security and cryptographic limits

The Service uses security controls intended to protect the systems it operates. No system is immune from failure or attack. Signature validity depends on key custody, certificate status, trust configuration, and verifier policy.

## 9. Disclaimers

Except for an express commitment in an approved written agreement, the Service is provided "as is" and "as available" to the extent allowed by law. Encypher disclaims implied warranties to the extent allowed by law.

## 10. Liability

Liability limits, exclusions, indemnities, governing law, and dispute terms in an approved order or agreement control where applicable. Where no separate written agreement applies, applicable law governs these matters. Nothing in these Terms excludes liability that cannot lawfully be excluded.

## 11. Suspension and termination

You may stop using the Service at any time. Encypher may suspend access for nonpayment, a material breach, a security threat, or a legal requirement. Terms that by their nature must survive termination remain in effect.
