Reddit v. Perplexity: The DMCA Ruling Publishers Are Misreading

Reddit's win against Perplexity is a DMCA anti-circumvention ruling. The technological lock the court analyzed belonged to Google, and robots.txt played no part in it.

A publisher's general counsel spent part of last week auditing her robots.txt file. She added explicit disallow directives for every named AI crawler, logged the date each one went live, and filed the record with outside counsel. She did this because the trade coverage of Reddit's win against Perplexity told her that a federal court had just given robots.txt legal weight. We read the opinion. Robots.txt appears in it once, in a footnote, as a passing example. The record she built will not do the work she built it for.

What the Court Decided

On July 31, 2026, Judge Paul Engelmayer of the Southern District of New York issued a 63-page opinion largely denying motions to dismiss brought by SerpApi and Perplexity AI in Reddit, Inc. v. SerpApi LLC, No. 1:25-cv-08736.

The claims that survived are not copyright infringement claims. Reddit did not bring one. Its user agreement grants it an irrevocable, non-exclusive license to user posts, and a non-exclusive licensee cannot sue for infringement under Section 501(b) of the Copyright Act. Reddit brought claims under Section 1201 of the DMCA, the anti-circumvention provision, along with New York common law claims. The docket records the distinction plainly: two days after filing, the clerk corrected the case classification from Nature of Suit 820, Copyright, to 890, Other Statutory Actions.

The court sustained the Section 1201(a)(1)(A) circumvention claims against both defendants, sustained the Section 1201(a)(2) trafficking claim against SerpApi, and sustained civil conspiracy. It dismissed the Section 1201(b) claim against SerpApi, and dismissed the unfair competition and unjust enrichment claims against both defendants as preempted by the Copyright Act. Most coverage has reported the denials and omitted the dismissals.

The Lock Belonged to Google

The technological protection measure at the center of the case is SearchGuard, Google's anti-bot system on Google's search results pages. Neither defendant is alleged to have touched Reddit's servers.

The sequence matters. Reddit users write posts. Reddit publishes them. Google indexes them and displays snippets on its results pages. SerpApi's tool, using rotating proxies and browser emulation, harvests those results pages at scale, bypassing SearchGuard. Perplexity buys the feed and sets the query parameters. Reddit's own defenses, its CAPTCHAs, its rate limits, its robots.txt, are described in the factual background and then play no part in the analysis. They were never engaged, because nobody came to Reddit's front door.

Robots.txt appears exactly once in the legal reasoning, on page 43, inside a footnote listing the measures companies invent to control access: "CAPTCHA challenges, encryption, passwords, and robot.txt files." No holding attaches to it.

Eight months earlier, a judge in the same district addressed robots.txt directly. In Ziff Davis v. OpenAI, Judge Sidney Stein dismissed a Section 1201 claim built on OpenAI's alleged disregard of robots.txt directives, on two independent grounds. Robots.txt does not effectively control access, because it is a request rather than a barrier; Stein compared it to a sign asking visitors to keep off the grass. And ignoring a request is not circumvention, which requires affirmatively disabling or voiding a control.

Engelmayer's treatment of SearchGuard reinforces that boundary rather than eroding it. SearchGuard qualified as an access control measure precisely because it does something robots.txt does not. The opinion rejects the argument that publicly reachable content cannot be protected, reasoning that SearchGuard "effectively blocks access by automated users while maintaining access for human users," and analogizing it to a facial-recognition system that opens a door for residents and not for other visitors. A measure that differentiates and refuses is a lock. A measure that asks is not.

We described this architecture in March, after the Ziff Davis ruling: robots.txt fails publishers for reasons no revision of the protocol can fix. This ruling does not disturb that conclusion. It illustrates it.

The Arrangement Theory Was Rejected

The second piece of advice circulating this week is that publishers should assess their rights in the editorial arrangement of their content, on the theory that the court relied on Reddit's protected arrangement of user posts.

Reddit did argue that. The court declined to credit it. In footnote 6 on page 15, the opinion acknowledges that a compiler may hold a copyright in a selection showing minimal creativity, and that infringement requires a defendant to have "substantially reproduced plaintiff's selection and arrangement." It then states: "Such, however, has not been pled here." Assuming for argument that Reddit's sequencing of posts is creative enough to protect, a Google results page shows a snippet of a single post. That the displayed post happens to be one Reddit chose to highlight does not make the snippet a substantial reproduction of Reddit's arrangement.

One caution for anyone pulling the PDF. The final sentence of that footnote is printed as "The Court therefore does rely on this asserted copyright interest in the ensuing analysis," with an evidently dropped negation. The surrounding reasoning is a rejection, and the arrangement theory never reappears in the remaining forty-eight pages. Reddit's copyright-based injury rests instead on the "tens of thousands of posts, comments, and other original works authored by Reddit itself."

What Publishers Actually Won

Two holdings in this opinion are more useful to publishers than the ones being promoted, and neither depends on robots.txt.

The first concerns who may sue. SerpApi argued that Reddit lacked a cause of action because it does not own the copyrights in user posts. The court read Section 1203(a), which permits "any person injured by a violation" to bring a civil action, against Section 501(b) of the Copyright Act, which limits infringement suits to the owner of an exclusive right. The DMCA contains no equivalent limitation. Licensees, platforms, aggregators, and distributors who are injured have a cause of action here that they would not have under the Copyright Act.

The second concerns whose lock counts. Section 1201(a)(3)(B) requires that a technological measure be applied with the authority of the copyright owner. It does not require the copyright owner to have built, deployed, or operated it. Reddit's users authorized Reddit to protect their content through the user agreement and public content policy. Reddit authorized Google to implement access controls over Reddit data through their licensing agreement. On that chain, the court found SearchGuard was implemented with the authorization of Reddit and its users.

The value of that holding is visible in the contrast with what happened eleven days earlier. On July 20, 2026, Chief Judge Yvonne Gonzalez Rogers of the Northern District of California dismissed Google's own DMCA suit against SerpApi over the same SearchGuard system. Google's complaint did not adequately plead that copyright owners had authorized the implementation. Reddit's did. Same defendant, same lock, opposite outcomes, and the difference sat in the pleading of a contractual relationship.

The court also declined to let a downstream data buyer shelter behind its supplier. Because Perplexity is alleged to set the circumvention parameters and run the queries itself, the opinion treats it as "more than a bystander to, or a downstream beneficiary of, SerpApi's circumvention." Whether Section 1201 supports secondary liability at all, the court expressly did not reach.

The Counterargument

The strongest objection is that this is a motion-to-dismiss ruling and proves nothing. That is correct. Nothing here is established. A court has found that Reddit's allegations, taken as true, state claims that may proceed to discovery. The defendants may still win.

A second objection carries more weight for most publishers. Reddit is a platform with more than a hundred million daily users, a licensing agreement with Google, and content it authored itself. A regional newspaper has none of those. The holdings above are only as good as the documents a publisher can produce.

Both objections are sound, and neither changes the architecture. A ruling on the pleadings determines what proceeds to discovery, which is what determines settlement leverage, and settlement leverage is the practical currency of this litigation wave. The authorization holding is also more useful to a small publisher than to a large one, because it means protection can be inherited from a distribution partner's infrastructure rather than built from scratch. What it requires is a contract that says so.

Why the Signal Has to Travel With the Content

Every fact in this case happened to Reddit's content while it was sitting in Google's index.

That is the structural lesson, and it is not specific to Reddit. Perimeter defenses govern an origin server. The moment content moves through syndication, licensing, aggregation, caching, or a single copy-paste, the origin's controls describe a place the content no longer occupies. Reddit's robots.txt was intact and irrelevant throughout.

A rights signal that survives this has to be carried by the content. That requirement is what Section A.7 of the C2PA specification addresses, published January 8, 2026 and developed through the C2PA consortium with review from Google, OpenAI, Adobe, Microsoft, the New York Times, BBC, and AP. We co-chair the Text Provenance Task Force and authored that section. A C2PA manifest embedded in a document at publication time binds authorship and licensing terms to the document itself, and it is tamper-evident: stripping or altering it is detectable. Our own technology extends this to sentence-level attribution, which the C2PA standard does not define. A C2PA manifest covers a document as a whole.

What that changes in a dispute like this one is evidentiary. A retrieval pipeline reads the credential at the moment it ingests the text, not by consulting a file on a server the content left months ago. A publisher who signs content before distribution can show what was published, when, and under what terms, and can demonstrate that a system holding that content held the notice along with it. That is the record the general counsel auditing her robots.txt was trying to build.

Reddit survived this motion because it could point to two documents: a licensing agreement authorizing Google to control access to its data, and content it wrote itself. Most publishers can produce neither. The open question is whether they will write the first into their distribution contracts and embed the second into everything they publish, or find out which paragraph they needed the way Google did eleven days earlier, in a different courtroom, against the same defendant.
